Va. Supreme Court Denies Fairfax Petition Vs. Falls Church

The Virginia Supreme Court, in a notification issued yesterday, has denied the Fairfax County Board of Supervisors petition for appeal of a lower court ruling dismissing all litigation seeking refunds for alleged overpayments of City of Falls Church water bills. In August 2011, Fairfax Circuit Court Judge Jane Roush granted Falls Church’s motion for dismissal of the cases because, under the applicable statute, the Fairfax Board and other plaintiffs filed their lawsuits in the wrong court.
